These Terms of Service ("Terms") govern your access to and use of the Swisox Data Studio and the Swisox Traffic Light System (together, the "Application"), operated by Swisox – The Sustainable Marketplace SA ("Swisox", "we", "us", or "our").

By accessing or using the Application, you agree to be legally bound by these Terms. If you do not agree, do not use the Application.

2. Nature of the Service

The Application is an informational tool that aggregates and classifies sustainability-related data on companies and financial products. It is designed for research, education, and transparency purposes only.

Swisox is not a broker, investment platform, financial advisor, or legal advisor. Use of the Application does not constitute financial, investment, legal, or tax advice, and does not create a fiduciary or client relationship of any kind.

3. Eligibility

  • You are at least 18 years old or the legal age of majority in your jurisdiction
  • You have the legal capacity to enter into a binding agreement
  • You comply with these Terms and all applicable laws

4. Account Registration

You may be required to register to access parts of the Application. By registering, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Accept full responsibility for all activities under your account

Swisox may suspend or terminate your access if we believe your account is compromised or used in violation of these Terms.

5. Intellectual Property

All content, features, designs, and data — including the Swisox Traffic Light System — are the exclusive property of Swisox or its licensors. You may not:

  • Copy, modify, reproduce, or distribute content
  • Use any part of the Application for commercial purposes without our written consent
  • Reverse engineer, extract, or decompile any source code or data

6. Use Restrictions

You agree not to use the Application:

  • For illegal, fraudulent, or malicious purposes
  • To impersonate Swisox or misrepresent your affiliation
  • To scrape, harvest, or mine data without authorization
  • To upload viruses or harmful code
  • In violation of applicable laws or third-party rights

7. Data and Content Disclaimer

Swisox makes no representation or warranty about the completeness, reliability, accuracy, or timeliness of any data in the Application, which may include user submissions or publicly available sources.

Use of the Application is at your own risk. Swisox does not verify or audit all content. You agree not to rely on it for financial or investment decisions.

8. No Advice

The Swisox Traffic Light System and all Application content are for informational purposes only. Nothing in the Application constitutes:

  • Investment advice
  • Legal or tax advice
  • A recommendation or endorsement

You are solely responsible for your decisions and should consult independent professionals as needed.

9. Limitation of Liability

To the fullest extent permitted by law:

  • The Application is provided “as is” and “as available”
  • Swisox disclaims all warranties, express or implied
  • Swisox is not liable for any indirect, incidental, punitive, or consequential damages
  • Swisox’s total liability will not exceed CHF 100, regardless of cause

10. Indemnification

You agree to defend, indemnify, and hold harmless Swisox and its affiliates from any claims, liabilities, damages, or costs (including legal fees) arising from your use of the Application or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Application at any time, for any reason, without notice or liability.

12. Governing Law & Jurisdiction

These Terms are governed by Swiss law. All disputes shall be resolved exclusively by the courts of Geneva, Switzerland, unless otherwise required by applicable law.

13. Changes to These Terms

We may update these Terms periodically. We will notify users of material changes within the Application or via email. Your continued use constitutes acceptance of the revised Terms.
